These terms apply when you buy a website, the SEO starter or the care plan from Upfront Sites. They’re written in plain English; if anything isn’t clear, email us at hello@upfrontsites.nz before you pay.
Who we are
Upfront Sites is the trading name of Mariano Genco, a sole trader based in Argentina who works online with businesses in New Zealand. Contact: hello@upfrontsites.nz.
Prices
- Our prices are in New Zealand dollars. We’re not registered for GST, so no GST is added.
- The prices on our website can change at any time. The price we confirm to you in writing is fixed for what you asked for, and it’s valid for the number of days shown in the calculator.
- Anything you ask for that isn’t in the confirmed price, like extra pages or features, is quoted before we do it.
Payments
- You pay a 50% deposit to start and the other 50% when your website is ready, before it goes live.
- You can pay by card, PayPal or bank transfer. Any fees your bank or payment provider charges are yours.
- Once we’ve sent you the first design, the deposit isn’t refundable.
Timeline
- Each website has its own timeline in working days, shown in the calculator and confirmed in writing, plus buffer days for anything unexpected.
- It starts when we have your deposit and all your content: text, photos, logo and, for stores, your product list.
- If we’re waiting on you for content or feedback, the timeline pauses. If we hear nothing for 60 days, we may close the project; the deposit isn’t refundable at that point.
Changes and warranty
- You get three rounds of changes on the design before your website goes live. Extra rounds are quoted first.
- For 15 days after launch, we fix at no cost anything we built that doesn’t work as it should. Changes to content or new features aren’t part of the warranty.
Domain and hosting
- Your .nz domain and hosting are included for the first year. The domain depends on availability and is included up to the amount shown in the calculator; if the one you choose costs more, you pay the difference.
- We register the domain for your business. It’s yours.
After the first year: the care plan
- From year two, the care plan covers hosting, your domain renewal, monthly updates, a monthly backup and small changes, in one yearly payment.
- It’s optional. We email you 30 days before it renews. If you’d rather host your website elsewhere, tell us before it expires and we’ll hand over a copy of your website and transfer your domain.
- If the care plan isn’t renewed and we don’t hear from you, we keep your website online for 30 days after it expires. After that, we may take it offline.
- Jobs that take more than 30 minutes aren’t covered by the care plan and are quoted first.
Online stores
- Payment provider accounts (like Stripe or PayPal) are in your name, and their fees are yours.
- You’re responsible for your products, prices, stock, tax settings and your terms of sale, shipping and returns.
SEO
We include basic SEO in every website, and the SEO starter goes further. Nobody can guarantee a position in Google, and neither do we.
Your content
- You confirm that you have the right to use the text, photos, logos and other material you send us.
- Once you’ve paid in full, the website and its content are yours. Themes, plugins and fonts stay under their own licences.
- We may show your website in our portfolio unless you ask us not to.
What’s not included
Unless we agree in writing: copywriting, photography, translations, custom features, paid third-party licences, advertising and legal advice.
Liability
- Because you’re buying our services for your business, the Consumer Guarantees Act 1993 doesn’t apply, to the extent the law allows.
- Our total liability to you is limited to the amount you’ve paid us for the service in question. We’re not liable for indirect losses, like lost profits.
- Nothing in these terms limits rights you have that can’t be excluded by law.
Ending the agreement
You can cancel at any time by email. We’ll keep the deposit if we’ve already sent you the first design, and charge for any further work done. We can end the agreement if you don’t pay what’s owed after a reminder.
Law
These terms are governed by New Zealand law.
Changes to these terms
We may update these terms. The version you agreed to when you sent your enquiry applies to your project.
